Our Fort Lauderdale car accident lawyers understand that car accidents are the number one cause of death for teenagers in the state of Florida.

It’s important that we help our newly-licensed drivers to get the driver’s education that they need to help them to stay out of accidents. That’s why officials with the Florida Department of Highway Safety and Motor Vehicles (DHSMV) are putting on Teen Driver Safety Week. This is a week-long campaign that takes place during the third full week of every October. It’s during this time that safe driving advocates work to spread the word about the importance of safe driving habits among our young drivers.

“It’s important that teens learn to be safe drivers from the beginning, and we encourage parents to be involved,” said the Director of the DHSMV, Col. David Brierton.

There are over 700,000 licensed teenagers in the state of Florida. Just last year, there were about 30,000 of them who were involved in fatal car accidents. In these crashes, there were close to 200 drivers between the ages of 15 and 19 who were killed. Many of these accidents and these fatalities could have been prevented if these newly-licensed drivers were offered a more thorough driving education.

During this week-long safe driving campaign, officials with the DHSMV and with the Florida Highway Patrol (FHP) will be visiting high schools across the state and will be putting on presentations to help to dramatize car accidents as viewed through the eyes of the responding paramedics. With these presentations, officials hope to bring home the message to young drivers about the importance of always wearing a seat belt, keeping the number of young passengers to a minimum, keeping distractions out of the driver’s seat and staying sober behind the wheel. Safe driving habits learned early on can turn into lifelong of safety.

Officials with the DHSMV are here to offer parents with a few pointers regarding safe driving habits and their teen. Review these Teen Driving Safety Tips and share them with the young driver in your family to help to keep them safe out there.

Teen Driving Safety Tips:

-Make sure every passenger is buckled up during every ride.

-Never drive under the influence of alcohol or drugs.

-Make sure the windshield is clean to help to maximize visibility.

-Avoid driving at night if you can.

-Make sure your vehicle always has enough gas. You never want to get yourself stuck on the side of the road.

-Keep the number of young passengers in the car to a minimum. Young passengers only increase your risks for an accident.

-Obey all road laws, this includes posted speed limits and other traffic devices.

-Always adjust your driving behaviors to accommodate the current weather, road and traffic conditions.

-You should always turn on your headlights during daylight driving.

Walking is going to get a little safer in the area. The Palm Beach County Office of Community Revitalization and the Palm Beach Metropolitan Planning Organization Board is getting close to $640,000 from the Florida Department of Transportation (FDOT) for a 2012 transportation enhancement grant and it’s all going toward helping pedestrians in the area. These funds are going toward the Canal Point Pedestrian Bridge Project, according to the Sun Sentinel. This project will be kicking off in 2015.
mnRXjTk.jpg

What this project is going to do is help to enhance and expand parts of the bicycle and pedestrian infrastructure in the area to improve safety programs, refurbish historic and scenic programs, beautify the area as well as help to preserve history and environmental mitigation.

Our West Palm Bewach pedestrian accident lawyers understand that the proposal to create this bridge came in as the most important among those seeking grants. This bridge will help to provide a safe and convenient way for pedestrians and bicyclists to cross over the L-10 Canal. On the other side of this canal are a number of businesses, residential areas and educational facilities.

The Metropolitan Planning Organization Board also claims that the bridge is going to help to complete much-needed infrastructure improvements and will provide job opportunities to the area.

Did you know that there is a pedestrian killed in a traffic accident every eight minutes in the United States? Most of these injuries are the result of not only motorist negligence, but also because of the lack of facilities for our walkers. By taking basic precautions and being aware of your surroundings, the likelihood of an accident can be significantly reduced.

Pedestrians are urged to use the city’s amenities to get around the area safely. One of the most beneficial amenities is our crosswalks. Officials with the City of Fort Lauderdale are here to offer your some crosswalk safety tips!

Crosswalk Safety Tips:

-Wait for the WAIT light before attempting to cross. WAIT does not mean to just start walking. You have to make sure that drivers are doing their part and are actually paying attention.

-Take off the headphones, turn off the MP3 player and put away your phone when crossing the street. Your full attention is needed in these areas.

-Look left, right and left again before starting to cross the street.

-Make eye contact with drivers before crossing in front of them. Make sure that they see you coming!

-Don’t cross the street if you don’t think you can make it all the way in enough time.

-Look for oncoming cars before stepping passed stopped vehicles.

-Keep an eye out for turning vehicles. They vehicles may be more worried about making their turn than passing pedestrians.

-Always hold the hands of young children.

A woman who was riding her mountain bike through Quiet Waters Park is now getting close to $18,000 from the Broward County Commission, according to the Sun Sentinel. What happened was she flew over the handlebars of her bike and nearly landed head-first on the trail below, seriously injuring her spine.
647831_cycle_race_10.jpg

The woman now has to pay more than $80,000 in medical bills because she fractured a cervical vertebrae in the accident. Officials are saying that they’re not dishing out the total costs because the woman was trespassing at the time of the accident. They add that she didn’t sign the proper waiver or watch the safety video before going out riding.

Our Broward County bicycle accident lawyers understand that there are trails for riders of all experience levels. There are some for more experienced riders, and those like the DNA trail for beginners. We also understand the popularity of biking in the area. Flat locale has been the dominate way for most of these cyclists to travel in recent years, but the trends seems to be shifting to path riding, with close to 23,000 riders registering for these paths in the last 2 years.

In many cases, the dangers occur when a path or trail (whether paved, or unpaved), intersects a road, railroad crossing, or other traffic point.

When riding on a mountain bike or riding along a trail, there are a few simple rules you should follow to help ensure that you have an enjoyable trip. Please review these tips and share them with your fellow riders to make sure that everyone has a safe and enjoyable ride!

Trail Biking Safety Tips:

-Only ride trails that meet your skill level. Never ride on a trail that’s too advanced for you. This is going to largely determine your risks for an accident!

-Only ride on open trails. Trails can close from time to time. If you’re ever uncertain of a trail’s status, ask a land manager. Avoid the risks and do not trespass on private land.

-Don’t leave a trace. Be aware of the dirt you’re riding on. If the trails are muddy and wet, you might want to give up on biking that day. These conditions also make it more dangerous for you to ride!

-Keep your bicycle under control. Inattention can put you and the cyclists around you in danger. Make sure you’re riding a bicycle that you’re familiar with and one that meets your skill level.

-Yield when necessary. Let your fellow bikers know when you’re coming. Try to anticipate other riders as you ride around corners. Make yourself as visible as possible!

-Always plan ahead. Know your equipment. Know where you’re riding. Know your schedule. Know what to do in the event of a weather change or an emergency.

For a state that has an abundant population of bicyclists and pedestrians, you’d think our roadways would be a little better equipped for the traffic.

Unfortunately, the utter lack of accomodations is a daily problem that many of these vulnerable travelers face. The Broward-Palm Beach New Times wanted to illustrate just how difficult it is to bike through the area. In a recent article, “Bike to the Everglades! An Illustrated Beginner’s Guide to Not Dying,” the difficulties are clearly illustrated, throughout text and pictures. There are a number of problems that bikers have to deal with, including blocked access, shoddy infrastructure, tiny and unmarked bike lanes and even concrete barriers.
1061228_blur_sign.jpg

Our Fort Lauderdale bicycle accident lawyers understand that biking through our city can be as risky as it is inviting. Walking, biking and even driving in the area can be a difficult, and dangerous, task — especially for bikers. Take Davie Boulevard for example. Heading west, there’s absolutely no bike lane for a majority of the ride. When a bike lane finally appears, you might miss it if you’re not paying attention as it’s hardly wide enough to fit one biker. Some don’t even call it a bike lane as there’s no bike painting on the cement.

Once you make it past Davie Boulevard, you can jump on University Boulevard. You might breath a sigh of relief as there’s a bike lane there. You’re only going to get a couple hundred feet though, as the path is blocked by a couple fences!

If the fences aren’t bad enough, when you hit Markham Park along 595 you’re going to run into some construction. Good luck getting through that mess!

If you’re lucky enough to make it passed there, you’re not off the hook. Every time you get to a north-south road that shoots off of 84, you’re not going to be able to cross. That’s right. They’re completely blocked by guard rails. You’re going to see signs that will tell you to “USE PED SIGNAL.”

Sounds easy, huh? Think again! At almost every pedestrian crossing in the area, you’ll find a mess of construction. These crossings have no buttons. They’re only equipped with a sign showing you where to cross, if you’re lucky enough to find a break in traffic.

If you make it this far, you’re coming up to Markham Park. When you get here, there’s a gavel path you can take. You don’t have to worry about traffic anymore, but you’ve got alligators to deal with, which you might be relieved to see after dealing with all of the problems while heading through the city.

This is a trip that many bicyclists take every day. The problems that they face are not much different than the obstacles that are faced all around the city. It makes you wonder — where are your tax dollars going?

Cough medicines. Sleep medicines. Antidepressants. Decongestants. Most of us have taken at least one of these at some point in our lives. But did you know that these medications can get you into a car accident?

Some medications, prescriptions and even over-the-counter drugs can increase your risks for a car accident by more than 40 percent. In some cases, your reactions behind the wheel can be equivalent to that of a driver who is legally drunk!
mgyptbs.jpg

Fort Lauderdale injury lawyers understand that there’s no getting around medications and prescriptions. Unfortunately, the use of these drugs is increasing in time with the growing population of elderly drivers. These are the ones who are most likely to be prescribed multiple medications. As a matter of fact, officials estimate that about 80 percent of drivers who are over the age of 64 are taking at least five medications, and often they haven’t talked with their doctor about the side effects.

Consumer Affairs reports drivers can use the Roadwise Rx tool from AAA to get customized information regarding their risks. All you have to do is visit the AAA website and go to the Roadwise Rx tool and enter in your prescription medication. The tool will offer you information about how these medications are reacting to one another, how they’re affecting your body and how they’re affecting your driving. While this tool is awfully resourceful and convenient, it’s not a replacement for a one-on-one with your doctor!

It’s estimated that about 10,000 Americans celebrate their 65th birthday each and every day. And Baby Boomers are expected to keep driving well into old age. As a matter of fact, officials estimate that one out of every six people will be 65-years-old or older by 2020. Officials also estimate that a good majority of these people will still have their driver’s licenses and will drive years longer than the elderly drivers of today.

“With medical conditions typically on the rise as people age, and treatment often dependent on medicinal interventions, there was a critical need to develop a tool to help older drivers understand the safety risk,” said Peter Kissinger, CEO and President of AAA.

Some over the counter medications, like Diphenhydramine, can seriously mess with a driver’s ability behind the wheel. According to researchers, this ingredient can give a driver the same abilities behind the wheel as one who is legally drunk.

We’re asking all drivers to be safe out there and to look into the prescriptions, medications and over-the-counter drugs they’re taking to make sure that their roadway safety is not in jeopardy. For some, it might even be better to stop driving altogether. There are other transportation options that can help to keep you safe!

You can use your child’s car seat during every car ride, but it’s not going to do any good if it’s not installed correctly. According to Consumer Affairs, a recent survey showed these seats are often used improperly by parents and guardians, even with the new technologies like Lower Anchors and Tethers for Children (LATCH), which are designed to make buckling these kids in a lot easier.
mrkDrJM.jpg
Officials with AAA recently talked to Child Passenger Safety Technicians (CPSTs) about how well adults are bucking children in these seats. These technicians are those who inspect and then properly install child car seats for parents who seek a little help. According to their feedback, the misuse of the LATCH system should be a top concern as misuse occurs about half of the time.

Fort Lauderdale injury lawyers understand how critical it is to make sure that children are properly buckled in during each and every car ride. Parents and guardians are the one and only line of defense against injury and even death in the event of a car accident. When these children are not properly buckled, their risks for injuries skyrocket! Don’t leave them to fend for themselves; make sure they’re protected every time you turn on the car. You can mean the difference between life and death for young passengers.

According to Jennifer Huebner-Davidson with AAA, an overwhelming majority of parents are putting their children at risk on our roadways.

The LATCH system has been used as standard equipment since being launched back in 2002. Typically, it’s regarded as a user-friendly system in place of the seat belt. Officials with the National Highway Traffic Safety Administration (NHTSA) say that about three-quarters of all parents who have experience using car seats say that they prefer the LATCH system.

This preference does not guarantee that it’s going to be used correctly though. According to a recent survey from the Insurance Institute for Highway Safety (IIHS), less than 15 percent of parents and guardians who volunteered for the study were able to properly buckle the LATCH system.

One of the biggest problems with putting these seats in the car is that parents aren’t placing the seat in the right position. For year now, adults have been told that it’s best to put them in the middle of the back seat. That’s not so much the case anymore. During recent safety studies, only 7 of the top 90 top-selling cars supported this system in the middle of the back seat.

Officials with AAA are urging parents to review the user manual of the seat to make sure it’s being used properly. Remember that a seat belt should be used to keep this child car seat in place. If there’s not one available, it should be moved to an outer seat.

The number of fatal car accidents in both Broward and Palm Beach counties is climbing steadily. Many find this alarming because of the recent reduction in all types of roadway fatalities nationwide.

According to the Sun Sentinel,. there were nearly 90 people who died in Palm Beach County through July 31st. That’s up from the 77 recorded during the same time in 2011. The same holds true in Broward County, where more than 105 recorded during this time in 2012 compares to the 87 reported in 2011.
1239215_graph_1.jpg

If this trend continues, officials are estimating that the number of traffic fatalities this year will surpass 2011.

But why are there more accident occurring in South Florida? Our Fort Lauderdale car accident lawyers understand that experts cite a number of reasons, including the distracted driving epidemic, the improving economy and the weather.

“I know for a fact distractions play a large role in traffic crashes,” said Lt. Tim Frith with the Florida Highway Patrol (FHP).

Many people believe that the biggest contributor to this problem is the lack in distracted driving laws in the state of Florida. As a matter of fact, the Sunshine State is one of the few states left in the country that has not enacted any kind of law to keep drivers off of their cell phone or their text messaging devices behind the wheel. Still, there were about 3,100 people killed in these kind of accidents nationwide last year.

Here in Florida, several laws were proposed in 2011 but lawmakers continue to reject them and allow drivers to do pretty much whatever they want to behind the wheel. Studies show that drivers understand the dangers and the risks that are associated with distracted driving. But still there are far too many who aren’t working to make the changes necessary to help to make our streets safer for all.

Unfortunately, it’s not just the distracted drivers who are hurt in these accidents either. It’s the state’s bicyclists and pedestrians, says Florida Rep. Irv Slosberg, D-Boca Raton. Slosberg knows just how devastating these accidents can be. Back in 1996, he lost his 14-year-old daughter in a car accident that involved a distracted driver.

The truth of the matter is that far too many people are dying on our roadways, and that’s a number that’s only increasing. Drivers are asked to be on their best behavior behind the wheel. Your safe driving habits may be the only thing that can help to bring down these numbers. Stay alert behind the wheel and keep distractions away from the driver!

There are more than 1.5 million Floridians who are expected to travel at least 50 miles from their home over the long Labor Day weekend. This is more than a 2.5 percent increase from last year, according to the Sun Sentinel.
mf1GjqG.jpg

More people are expected to travel by car in the state of Florida than the rest of the nation. About 87 percent of Floridians will be hitting the road over the long holiday weekend, while only 85 percent of the nation as a whole will be using this form of transportation, according to AAA. They’re going to be paying more to get there, too. Gas prices are up close to 40 cents from this time last year. Currently, an average gallon of gas in Fort Lauderdale sits at about $3.79.

Fort Lauderdale personal injury attorneys are asking everyone to be on their very best driving behavior over the holiday weekend. More travelers means busier roadways and higher risks for accidents. As a matter of fact, there are more than 400 people who are expected to be killed in car accidents over the holiday weekend, according to the National Safety Council (NSC). Officials are also predicting that there will be another 41,000 injuries because of car accidents.

Across the United States, there are close to 35 million people who are going to travel at least 50 miles to their Labor Day destination.

For statistics-keeping purposes, the Labor Day holiday weekend is specifically designed as the time from 6:00 p.m. on Friday the 31st all the way through 11:59 p.m. on Monday the 3rd. This is going to be some of the most dangerous three days out of the entire year.

Drivers are asked to safe while driving to help make our roadways safe for everyone. Officials with the NSC are here to offer you some safe driving tips to help you to ensure that safety.

Labor Day Tips for Your Road Trip:

-Never drink and drive. Make sure that you always have a designated driver or another sober way to get home.

-Make sure your seat belt is always buckled. This will help you to stay safe should you get into an accident.

-Check out traffic, weather and road conditions before heading out. Check for delays.

-Never engage in distractions as the driver.

-Make sure you know exactly where you’re going before you head out, too. This will help you to avoid road maps and GPS devices while driving and to keep your eyes on the road.

-Always travel after a full night of sleep. Avoid drowsy driving.

-Allow plenty of travel time to avoid frustration and diminish the impulse to speed.

The 13th Street Business Alliance of Fort Lauderdale recently voted to hold off on the project to install pedestrian street lamps in the area. According to the Sun Sentinel, the Alliance decided that they were going to wait until the application for county funding goes through before making a move. That’s not expected to be completed until later in the fall.
264995_100_dollars.jpg

“They’re expensive, and we’ve already had the money appropriated for them,” said Tim Smith, president of the 13th Street Business Alliance. “But we’re applying for Broward County money and it’s likely we’ll have to match it.”

Our Fort Lauderdale pedestrian accident lawyers understand the importance of these lamps. Lights help to make pedestrians more visible to passing motorists. All too often, walkers are overlooked by motorists and find themselves in serious, if not fatal, accidents because of it. Our city needs to do everything it can to help pedestrian traffic. The state of Florida, especially the South Florida area, continues to be ranked one of the most dangerous areas for pedestrians in the entire country.

Back in January, the Community Redevelopment Agency was looking at this part of Fort Lauderdale for improvements to make traffic flow more smoothly and to make the area more pedestrian-friendly. Unfortunately, funding is an issue. Since then, the Alliance has appealed to the County Commission and to the City and has requested whatever funds might be available to the area.

Smith said they’re ready to do anything that they have to just to get their hands on funding. It’s a necessity and the area needs improvement for the safety of travelers.

The city of Fort Lauderdale has put up nearly $80,000 from its Business Capital Improvement Program. Smith says getting money from the county is another story, a long and drawn out story. He hopes that this will soon come to an end when the alliance presents their proposition in just a few months.

The treasurer of the Alliance, Mark Hensel, says that they just want safer areas for travelers. He adds that it’s clear that the area needs help. He says it should be no big deal if the Community Redevelopment Agency were to do its job; properly tax the area so that funds could be pumped back into it to make is better for all.

Smith says they’re not asking for much, only what they deserve. He said the area owes it to their residents. All they want is better lighting, more parking and safer pedestrian walkways and they’re ready to do whatever they have to to get their hands on it.

The state of Florida is known for having the deadliest roads in the country. A number of bicyclists who have experienced the dangers of these roadways firsthand have decided to launch a campaign to raise awareness about the vulnerable travelers, bicyclists and pedestrians, in the state.

The campaign is also working to get government officials to better plan street design, to create more bike paths and to get more enforcement from law enforcement officials, according to the Sun Sentinel. It’s all about changing the travel mindset of the area. We’ve all got to be more aware of one another on our roads. We’re all one big Florida family and we all need to respect fellow travelers.
941665_bicycles.jpg

“We’re trying to change the habits of the drivers as well as bicyclists and pedestrians,” said Eric Carr with the Florida DOT.

Our Fort Lauderdale bicycle accident attorneys understand that the number of overall traffic fatalities has decreased in recent years, but not the number of pedestrian fatalities. With the year-round warm weather that we have throughout the state, pedestrian and bicyclists are at increased risk. In all areas, more pedestrians and bicyclists means more accidents, more injuries and more fatalities.

The new campaign is funded by nearly $8 million in both state and federal grants. Through it, there are four Es to get the message across: Engineering. Education. Enforcement. Emergency Services.

Bicycle Accident Stats, 2010:

-Broward County: 554 injured and 5 killed.

-Palm Beach County: 367 injured and 4 killed.

Bicycle Accident Characteristics, 2010:

-Bicycles were most likely hit in the front. Very rarely were bicycles struck from the back.

-About half of all reported bicycle accidents happened at intersections or were influenced by intersections.

-More than 25 percent of the vehicles that were involved in bicycle accidents were turning right at the time of the accident. About 10 percent involved were making a left-hand turn and about 45 percent were heading straight.

-Nearly 80 percent of the bicyclists that were involved in accidents were heading straight.

-Careless driving and neglecting to yield on the part of the vehicle driver was listed as the cause of accident in about a quarter of all fatalities.

-Careless driving and neglecting to yield on the part of the bicyclist was listed as the cause of the accident in more than 15 percent of accidents.

The campaign consists of billboards, TV ads and bus stop ads in four targeted areas that consistently place among the top 10 in pedestrian and bicycle deaths in the country: South Florida, Tampa and St. Petersburg, Orlando and Jacksonville. The message is simple: “Alert today, alive tomorrow.”

You’re asked to join in on the spirit of the campaign and to stay alert when traveling, regardless of how you get around. We all need to pay attention to one another to keep our Florida roads safe and our Florida family safer.
